1. Introduction

Welcome to Edvance SMS ("the Service"). By using our website, apps, or any of our services, you agree to be bound by these Terms of Service ("Terms").

Please read these Terms carefully. They govern your use of the Edvance SMS platform and services. If you do not agree with these Terms, please do not use the Service.

2. Definitions

"Edvance SMS" (or "we", "our", or "us") refers to the providers and operators of the Service.

"User" (or "you", "your") refers to individuals or entities that access or use the Service.

"Content" refers to all information and materials (including text, images, audio, video, etc.) that users submit, upload, or share through the Service.

"School" refers to the educational institution that has subscribed to use the Service.

3. Account Registration

To access certain features of the Service, you may need to register for an account. When you register, you agree to provide accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Responsibilities

You agree to use the Service in compliance with all applicable laws and regulations.

You agree not to:

• Upload or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Use any robot, spider, or other automated means to access the Service.
• Circumvent any measures we use to prevent or restrict access to the Service.

5. Data Privacy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy.

For schools subject to regulations like FERPA (Family Educational Rights and Privacy Act), we serve as a "school official" with a "legitimate educational interest" as defined by FERPA.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Edvance SMS and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material from our Service without prior written consent.

7. Subscription and Billing

Access to the Service requires a valid subscription. Subscription fees are based on the number of students and selected features.

Unless otherwise specified, subscriptions are billed annually and automatically renew unless canceled before the renewal date.

All payments are non-refundable, except as required by law or as specifically outlined in these Terms.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms.

Upon termination, you will have 30 days to export your data from the Service. After this period, we may permanently delete your account and data.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

IN NO EVENT SHALL EDVANCE SMS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO EDVANCE SMS DURING THE 12-MONTH PERIOD PRIOR TO THE DATE OF THE CLAIM.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on the Service and updating the "Last updated" date.

Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Cameroon, without regard to its conflict of law provisions.
